These Terms govern your use of Kuntum & Embun (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Account eligibility
You must be at least 18 years old. We accept users worldwide but the Service is primarily designed for the Malaysian tech market. By registering, you represent that the information you submit is accurate.
2. Permitted use
- Searching for and applying to jobs (candidate side).
- Posting jobs and reviewing candidates who have marked interest in your roles (employer side / Embun).
- Using AI matching, scoring, and coaching features for personal/business purposes.
3. Prohibited use
- Automated harvesting of platform content, candidate data, or job postings.
- Automated account creation or fake-profile generation.
- Spam, harassment, discrimination, or unsolicited solicitation.
- Sharing account credentials or impersonating another person.
- Reverse-engineering, decompiling, or attempting to extract our AI models.
- Using the Service to violate Malaysian or applicable foreign law.
4. Content ownership
You retain all rights to the resume content, profile information, and messages you submit. By using the Service, you grant Kuntum a non-exclusive, worldwide license to process your data for matching, scoring, sharing your professional profile with employers when you mark interest in their roles, and otherwise providing the Service. This license terminates when you delete your account.
5. Accuracy of submitted content
You agree to submit only accurate information. Misrepresenting your skills, experience, or identity is grounds for account suspension.
6. AI matching disclaimer
AI scoring and match recommendations are informational. We do not guarantee any matching outcome, interview, or hiring decision. Our AI is a tool to surface possibilities — it is not a substitute for your own judgment or the employer's hiring process.
7. Employer obligations (Embun)
If you use the Service as an employer, you receive candidate profiles only for candidates who have marked interest in your roles. You agree to:
- use that data solely to evaluate the candidate for the role they engaged with;
- not redistribute, resell, scrape, export in bulk, or repurpose candidate data for any other role, company, or use;
- communicate with candidates only through the platform's brokered channels — you do not receive a candidate's email or phone unless the candidate deliberately chooses to share them with you;
- comply with the Personal Data Protection Act 2010 (Malaysia) in your handling of any candidate data you receive.
Breach of these obligations is grounds for immediate suspension under Section 8 and may expose you to liability under PDPA.
8. Account suspension and termination
We may suspend or terminate your account if you violate these Terms, if your conduct creates risk for other users, or if a regulator orders us to do so. We will give reasonable notice when possible. You may terminate your account at any time via /account/data.
9. Disclaimer of warranty
The Service is provided "as is" without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.
10. Limitation of liability
To the maximum extent permitted by Malaysian law, our total liability to you for any claim arising from or related to the Service is limited to MYR 100, or fees you paid us in the previous 6 months, whichever is higher. In no event will we be liable for indirect, incidental, special, or consequential damages.
11. Force majeure
Neither party is liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, government action, internet or telecommunications failures, cyberattacks, war, terrorism, or labour disputes.
12. Class action waiver
You agree to resolve any dispute with us individually. You waive any right to participate as a plaintiff or class member in a class action, consolidated action, or representative action against us.
13. Governing law and disputes
These Terms are governed by the laws of Malaysia. Any dispute will be resolved in the Malaysian courts.
14. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force.
15. Modifications
We may update these Terms from time to time. Material changes will be notified to users and reflected in the "Last updated" date at the top of this page, and where required by law, your consent will be obtained before such changes take effect.
